A Dallas County judge is likely to hear arguments Monday afternoon that may influence how a House District 105 recount proceeds. Democrat Rob Romano lost the contest to state Rep. Linda Harper-Brown (R-Irving) by 20 votes. Now, Romano and the Democratic Party filed suit to ensure that so-called emphasis votes are counted, the Dallas Morning News reports.
At issue is the "intent of some straight-party voters" who used electronic voting machines. For example, if a Democratic voter opted to vote straight-Democratic ticket, but then selected Romano too, the machine would deselect Romano's name. Unless the voter selects another candidate, no vote is counted for that race.
